RealRewards Terms & Conditions |
Electronic Commerce Technology Sdn Bhd, along with RealRewards participating merchants (Merchants), wants you to value and enjoy your membership in this programme. It should be fun and rewarding for you. These Terms and Conditions govern both the operation of and your participation in the RealRewards Programme (Programme). They describe what you can expect from RealRewards and what are expected of you as a Member. |

Introduction |

| 1.1 |
RealRewards Programme is operated under licence in Malaysia and managed by Electronic Commerce Technology Sdn Bhd (ECT). Registered Members of the Programme (Members) are extended the privilege of earning points (Points) from Participating Merchants when making purchases of goods and services from Participating Merchants which qualify for Points under the Programme. Members can then redeem those Points for free merchandise, vouchers and travel (Rewards) from the RealRewards catalogue. |

Every effort is made to ensure that information supplied to Members is correct. However, ECT will not be liable for any inaccuracy or erroneous description or information on the Programme and these Terms and Conditions. |

| 2. |
Program Participation |
| |
| 2.1 |
To participate in the Programme, you must be a Member. As a Member, you must complete, sign and return the Programme registration form. On-line membership registration is also available via access to www.realrewards.com.my. ECT reserves the right to determine who shall be eligible for membership in the Programme. |
| 2.2 |
Membership applications are open to all residents of Malaysia who are 16 years of age or older. |
| 2.3 |
When ECT approves the application for membership, ECT shall issue the Member with a RealRewards card. |
| 2.4 |
ECT may issue pre-approved cards at selected outlets in the manner as agreed by ECT. |
| 2.5 |
Your membership will commence the first time you use your RealRewards card and earn Points. You are deemed to have accepted and agreed to abide to the Terms and Conditions herein when the RealRewards card is first used. |
| 2.6 |
Only one RealRewards membership is available per person. |
| 2.7 |
The Points may be redeemed for free Rewards only according to the Terms and Conditions of the Programme as set out herein. |

| 3. |
Member Cards |
| |
| 3.1 |
Upon completing and signing your registration form and approval for membership (if applicable) whereupon you will be issued your RealRewards card, your name will be entered in the records of ECT as a Member of the Program. |
| 3.2 |
A computerized account in the name of the Member will be opened for each Member by ECT, which will be entered in the records of the Programme. |
| 3.3 |
Members are responsible for keeping their address and other personal particulars in the records of ECT up-to-date. ECT will not be responsible for any loss of data or information or for any loss that may occur to any Member due to failure of ECT’s recording system or for any other reason. |
| 3.4 |
Members may request Supplementary cards for their immediate family members (which will be issued at the sole discretion of ECT). All Points earned in connection with such Supplementary cards will be credited to the account of the principal Member. |
| 3.5 |
The RealRewards card is a Member identification card only. It is not a charge, credit or debit card. The RealRewards card may not be assigned or transferred. |
| 3.6 |
The RealRewards card is the sole and exclusive property of ECT. As the programme manager, ECT may revoke and cancel any of the RealRewards card if the Member fails to comply with any of these Terms and Conditions. In the event that the RealRewards card is revoked or canceled for reasons stated in Clause 6.1, ECT reserves the right to cancel all Points earned in relation to that Member’s account and/or to refuse to allow that Member to make any redemption (s) with their accrued Points. |

Members shall immediately inform ECT of lost or stolen cards:

A replacement card will be provided to the registered Member upon verification of proper identification. Members are required to pay RM5.00 or deduct 300 points for each replacement card from the Member’s accumulated Points after the replacement card has been posted to the Member. |
| 3.8 |
Should a lost card be found and used by a third party, all Points related to any purchase made will be adjusted into the correct account once ECT becomes aware of the same. |
| 3.9 |
ECT will not be responsible for any delay in replacing a lost or stolen card, for unauthorized use of a card, or for delayed or lost correspondence, whether in the mail or otherwise or for any loss arising from the same. |

| 4. |
Points |
| |
| 4.1 |
The Points issued by Participating Merchants will not be considered Points until notification of the issue of such Points has been received and recorded by ECT in the relevant Member’s account. Similarly, other vouchers or rights issued or provided by Participating Merchants which are convertible into Points, will not be considered Points until properly converted and notification of the issue of such Points has been received and recorded by ECT in the relevant Member’s account. ECT will not be responsible for the delay or failure of any Participating Merchant in giving notification to ECT of the Points awarded to Members. ECT reserves the right to reverse the Points originally awarded to the Members due to breach in the agreement between Participating Merchant and ECT. |
| 4.2 |
Subject to these Terms and Conditions, all Points awarded shall be free from time limitation. |
| 4.3 |
The Points awarded to Members may only be redeemed by the primary registered Member and are strictly non-transferable. |
| 4.4 |
The Points have no cash value and are not exchangeable for cash. |
| 4.5 |
Members may be awarded the Points by making qualifying purchases of goods and services of qualifying amounts at the outlets of the Participating Merchants if the Member produces its RealRewards card and allowing the said RealRewards to be swiped at the said outlet when making the said purchase. |
| 4.6 |
In the case of refunds made by the Participating Merchants in respect of goods and/or services purchased by a Member, the Points earned in respect of such purchase will be deducted from that Member’s account with ECT. |
| 4.7 |
Participating Merchants will determine the conditions under which they will permit you to obtain Points from them (including the number of Points to be awarded for each purchase) and may change those conditions. The issuance of Points by Participating Merchants shall be a matter to be resolved between the Participating Merchant and the Member. ECT shall not be responsible for any loss or expense suffered or incurred by the Member or any other parties in connection with any dispute with the participating Merchants. |
| 4.8 |
ECT will only credit your account with the Points you earn from Participating Merchant which has a valid and binding agreement with ECT in respect of the Programme and is in force at the time of purchase and the Participating Merchant is not in breach of such agreement. |
| 4.9 |
ECT reserves the right to delay recording Points in your account until it has been confirmed that they were properly issued or awarded. ECT reserves the right not to record such Points where such confirmation cannot be obtained; or if the Points have already been recorded, ECT may cancel them. ECT may also cancel recorded Points if the participating Merchant directs ECT to cancel the Points (for example because the Member returned or did not pay for the goods or services for which the Points were issued). Any dispute with respect to such matters must be settled between the Member and the participating Merchant. |
| 4.10 |
Members can check their available Points balance at any time by calling RealRewards Member Services number at: 03 8023 2626 or log in to RealRewards website at www.realrewards.com.my. Subject to these Terms and Conditions, printed account statement updates will be mailed to Members on a regular basis. The outstanding balance of Points as recorded in the Members computerized account maintained by ECT will be deemed correct, save for manifest error. If you believe that there is an error in your account records, you must inform ECT in writing within fourteen (14) days of the date when the relevant account details were provided to you by ECT, failing which you are deemed to have accepted the account. |

| 5. |
Redemption of Points for Rewards |
| |
| 5.1 |
The Points are redeemable for Rewards as set out in the RealRewards catalogue, or for other special Rewards that may be made available from time to time by ECT. |
| 5.2 |
When sufficient Points have been accumulated to obtain a Reward from the RealRewards catalogue or other special reward offer, the Member must call the Member Services number provided or complete and return the Rewards Request form provided in the RealRewards catalogue in accordance with the catalogue terms and request the desired Reward by its designated item number. The Rewards Request will be processed upon positive identification of the Member and verification that the Member is entitled to redeem the desired Reward. All Rewards Request received may not be exchanged, revoked, canceled nor refunded. The collection of such Reward must be made within three (3) months from the date of the Reward Request form. Any failure on the part of the Members to do so for any reasons whatsoever may result in the loss of Points, as no extension of time shall be entertained.
In the event that a Member transacts less than six (6) times or accumulated less than 500 Points within one (1) year, ECT shall not be obliged to send any catalogues, newsletters, statements and any other communication materials to such Member. The Member is advised to call our Member Services Consultants at 03-8023 2626; or make enquiries at the Member Services Centre; or visit our website at www.realrewards.com.my for further clarification. |
| 5.3 |
All Rewards requested must be from the current RealRewards catalogue OR within the specified period for special reward offers; and will be sent prepaid to the Member at the Member_s latest address recorded by ECT. All Rewards does not include the relevant installation and/or service fee (as the case may be) and any such additional cost shall be borne by the members. Allow 4 to 6 weeks for delivery. Members or their authorized representatives will be required to sign for deliveries and such acknowledgment shall supersede any claims and/or complain of non delivery of Reward. In the event that ECT is unable to make delivery of any Reward(s) to the Member or their authorized representatives within two attempts, the Member will have to pay any subsequent delivery costs incurred by ECT as ECT may then inform the Member. |
| 5.4 |
For Rewards specified under the special reward offer, the redemption of such Reward and/or Point shall be subjected to the special terms and conditions attached thereto and all Rewards and/or use of Rewards in terms of vouchers and/or certificates shall only be valid at the specific Participating Merchant either stated on the vouchers or otherwise. All Rewards under special reward offer must be redeemed within the stipulated period of offer or otherwise they shall become null and void. |
| 5.5 |
Subject to the provisions of Clause 5.3, all Rewards shall be subjected to additional terms and conditions set by the relevant Participating Merchant and/or service provider. ECT shall not be responsible for any loss and/or damage suffered by any of the Members for any failure on the part of such Members to adhere to any such terms and conditions either directly or indirectly. Any Rewards with regard to vouchers and/or certificates shall only be valid at the relevant outlet specifically stated on the said vouchers and/or certificates. With regard to any Rewards requiring any reservations, the members shall take their own necessary effort to make such necessary arrangement. ECT shall not be liable for any such arrangement. |
| 5.6 |
Members are advised to examine the Rewards received or delivered. Any faulty and/or damaged Rewards must be returned to ECT via the delivery person immediately, failing which the necessary cost incidental for the returning of the Reward shall be borne by the Member. |
| 5.7 |
Any delivery outside Malaysia shall be charged in accordance with the current ordinary postage cost. In the event that the Rewards is returned undelivered for whatsoever reasons, the item(s) shall be kept in RealRewards storage for three (3) months from the date of receiving and thereafter if not claimed by Members, RealRewards shall at its own absolute discretion, dispose it to charitable organization or any other party it sees fit. |
| 5.8 |
Upon the Member requesting the redemption of Points for a Reward, the relevant number of Points will be deducted from the Member’s account. The balance of Points in the Members account will continue to be valid and may be used to redeem further Rewards. |
| 5.9 |
The Points may be redeemed for Rewards only by the Member upon verification of identity and such other particulars as may be required by ECT, and not by holders of Supplementary Cards. You may only redeem Points that have been recorded in your account with ECT. Members may not combine their Points with those of other Members to redeem for Rewards. |
| 5.10 |
Rewards set out in the RealRewards catalogue are available only through the redemption of Points and are not available for purchase. |
| 5.11 |
Self-collect redemption orders require advance notice and can be picked up 2 weeks after order is made. Self-collect orders that are not collected within 6 weeks from the order date will be delivered to member at the redeemed item’s delivery points. Members opting for walk-in redemption is subject to stocks availability. |
| 5.12 |
The RealFast Way redemption option is only available at the Rewards points and values fixed and published in the current RealRewards catalogue or other special rewards offer. For payment via credit card, member hereby authorizes ECT to debit his credit card account to pay the said value portion of the redemption and Rewards points will be deducted. For payment via cheque, the redemption will only be processed upon cheque clearance. All cheques must be crossed and made payable to 'Electronic Commerce Technology Sdn. Bhd.' |
| 5.13 |
All Rewards are subject to availability of merchandise and to the suppliers’ restrictions. Due to changes in the cost of goods and services charged to us by our suppliers and other factors, the number of Points required for Rewards as set out in the RealRewards catalogue is subject to change at any time without prior notice to Members. ECT further reserves the right to revise, vary, delete or substitute all or part of the RealRewards catalogue at any time. |
| 5.14 |
If Rewards received are damaged or defective in any way, they may be returned for a replacement or credited into the Member’s account for the number of Points redeemed to obtain the item. RealRewards Member Services must receive notice from the Member of the damage and/or defect within 7 days of receipt, failing which any such complain and/or replacement must be dealt directly with the supplier. In the case of replacement, ECT reserves the right to substitute a similar item of equal or superior value. |
| 5.15 |
Save as provided on Clause 5.14, Rewards is not returnable. |
| 5.16 |
All Rewards carry the warranty of their manufacturer. ECT makes no product representatives or warranties, express or implied, and disclaim any and all liabilities, as to the condition, quality, merchantability or fitness for use of products and/or services provided through this Programme.
The Programme only arranges for manufacturers or distributors to make available their products to Members in exchange for Points. The Programme and ECT will not be responsible for any loss or injury suffered by Members and/or third parties in connection with such products. By applying for and using your RealRewards card, you are expressly waiving any rights or claims of liability against the Programme and/or ECT and/or any of its officers or agents for any products or services provided under the Programme. ECT’s sole obligation under the Programme and pursuant to these Terms and Conditions is to use its best efforts to keep an account of the number of Points earned and/or redeemed by Members, and to administer the Programme in respect of the Points. |
| 5.17 |
Members are responsible for any taxes that may be imposed by the relevant authority in connection of Points obtained and the redemption of Rewards made by the Members. |
| 5.18 |
ECT is not liable for any delay or error in the details of your account, including its accumulation of Points. You must keep your account details up-to-date. |
| 5.19 |
ECT reserve the right to refuse the redemption of any Rewards or recall the redeemed Rewards if ECT has any reason to suspect the Points were fraudulently accumulated by you or wrongly recorded. |
| 5.20 |
ECT reserves the right to make changes on the redemption points in the RealRewards catalogue without prior notice. |

| 6. |
Changes, Breach and Termination |
| |
| 6.1 |
If:
| i. |
you fail to observe or comply with these Terms and Conditions (which includes any addition or variation thereto); |
| ii. |
no transaction in your account for a consecutive twelve (12) months period; or |
| iii. |
ECT suspects that the Points were fraudulently accumulated or wrongly recorded or you have misrepresented any information provided for the Program. |
| iv. |
deceased or declared bankrupt. |
ECT may at its own discretion cancel your RealRewards card and membership without notice and upon cancellation of the RealRewards card and membership, all accumulated Points shall become void and irredeemable for Rewards. |
| 6.2 |
In the event of a Member’s death, the RealRewards membership will be automatically terminated. Upon written request and proof of death, any Points in the deceased account may be transferred to the account of the Member’s spouse, children or parents with proof of relationship. The points may be transferred to only one account and may no be divided amongst multiple accounts. |
| 6.3 |
Membership in the Programme and all related benefits are offered at the sole discretion of ECT. ECT reserves the rights, from time to time, to restrict, suspend, or otherwise alter aspects of these Terms and Conditions, with or without notice to the members, which changes may affect the value of Points already accumulated. |

| 7. |
General |
| |
| 7.1 |
Any notice, communication, summary or other Programme materials to be given pursuant to these Terms and Conditions shall be sufficiently sent to you by ordinary post to your mailing address according to ECT’s records and shall be deemed to have been delivered five (5) working days from the date of its posting. Members are responsible for informing ECT of any change of name or address promptly. Unless otherwise specified, all notices to ECT shall be sent to:

| 7.2 |
ECT reserves the right not to send any mail, Points statement, Programme materials (which includes but not limited to catalogues and newsletters) or written communication to Members who do not meet the minimum transaction frequency and/or minimum criteria as may be determined by ECT |
| 7.3 |
Members who do not receive any mail, Points statement, Program materials or written communication pursuant to Clause 7.2 are advised to call our Member Service number at 03-8023 2626 for further information. |
| 7.4 |
ECT is not the manufacturer or supplier of any product or service provided by Participating Merchants. We are not responsible for, and your rights and obligations as a Member will not be affected by, any offer, advertisement, representation or other statement made by any other person, including Participating Merchants; and they and their products/brands/services will be held harmless from any action or dispute arising from the operation of the Programme and the redemption and delivery of the Rewards. |
| 7.5 |
ECT is the final authority as to the interpretation of these Terms and Conditions and as to any other questions or disputes regarding the Programme or any Rewards. ECT will not be taken to have waived any of its rights, even if it redeemed or honors Points when not obliged to do so under these Terms and Conditions. |
| 7.6 |
The Programme and these Terms and Conditions are governed by and shall be construed in accordance with the laws of Malaysia. Members hereby expressly submit to the non-exclusive jurisdiction of the courts of Malaysia. |
| 7.7 |
From time to time, ECT may make available its member list to Participating Merchants for the purpose of informing and/or circulating special newsletters or offers for their products or services. If you prefer not to receive such circulation or any telephone calls from the Participating Merchants, please write to us and let us know at the address shown in Clause 7.1. |
| 7.8 |
These Terms and Conditions are also available in Bahasa Melayu version. In the event of inconsistency, the English version shall prevail. |
